Terms and Conditions
Definitions 1. Electronic communications
'Client' refers to the user(s) of any Safescribe services.
'Company' refers to Safescribe
'Services' refers to the services that have been agreed by both the company and client as stated on the confirmation e-mail that
the client receives upon placing and paying for an order.
When you visit Safescribe.co.uk or communicate with us by e-mail, this involves the electronic transfer of data. You consent to us communicating with you via e-mail. You agree that the legal requirement for materials to be in writing is fulfilled by e-mail communications. You acknowledge that the internet is not a completely secure medium and you accept the risks involved in delivery of services.
2. License and site access
The company grants you a limited license to access this site. The company does not grant you license to download or modify any aspect of it (other than page caching) except with the written consent of the company. No aspect of this site may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose except with the written consent of the company. You may not use any meta-tags or any other hidden text utilising the company's name or trademarks except with written consent. You may not create a hyperlink to Safescribe.co.uk that portrays the company, or its services, in a false, misleading, derogatory, or otherwise offensive matter.
3. Ownership of documents
The client retains sole copyright, ownership and control over all materials submitted to the company for proofreading and editing, including any materials subsequently created or developed by the company.
4. Formation of Contract
4.1: The contract begins when the client has submitted an order and this has been confirmed by the company via e-mail.
4.2: All services provided by the company are subject to the availability of the necessary editors. Under circumstances whereby the company is unable to find an editor within 72 hours of receipt of payment,
it will refund the client in full and will be held under no obligation to complete the work.
There can be no liability to the client with regards to non-completion of services.
5. Refusal or denial of services
The company reserves the right to deny or refuse service to any client or prospective client for any reason and without explanation. In these instances, a full refund will be provided.
6. Financial fraud or theft
The company is not liable for the fraudulent use of any credit card or other payment method that may be used to purchase its services.
7. Cancellation
7.1: In the event that the client wishes to cancel the service, the cancellation request must be sent via e-mail to cancellations@safescribe.co.uk within 24 hours of the receipt of the confirmation email.
7.2: The email must be sent from the same e-mail address supplied on the order form, and must state the order number in the subject field.
7.3: Should the editor to whom the order has been assigned have already accepted the assignment (by e-mail to the co-ordinator) before the time of the cancellation request being received, no refund will be provided. Therefore, although 24 hours from the receipt of the confirmation email is the maximum validity period for cancellation (see 7.1), clients should be aware that the sooner the cancellation request is made, the more likely it is to be accepted.
7.4: Provided that terms 7.1 and 7.2 are met, and the circumstances detailed in 7.3 do not apply, the client will receive a refund, which may involve deductions of any associated costs incurred by the company, including bank/transfer fees and administrator/editor costs if applicable.
8. Delays
8.1: The company takes punctuality of service very seriously. However, in the unlikely event that there is a delay in our service, the client will receive a partial or full refund according to 8.2-8.5
8.2: If the service is supplied less than 24 hours late, a 10% refund of the fee will be provided
8.3: If the service is supplied more than 24 hours late, but less than 7 days late, a 50% refund will be provided.
8.4: If the service is supplied more than 7 days late, a 100% refund will be provided.
8.5: If the service is more than 7 days late then the client has the right to a full refund from the company. In this instance, if a refund is requested the product will not be delivered.
All such requests should be made by e-mail to customerservice@safescribe.co.uk and should be sent from the e-mail address used for the order. The email should include the order number in the subject field.
9. Refunds
Except in the circumstances detailed in the above sections of the terms and conditions, there is no obligation upon the company to provide a refund under any circumstances. The company does intend to maintain exceptional levels of client satisfaction, and the client is invited to inform us by e-mail (customerservice@safescribe.co.uk) within 72 hours of receipt of the edited document, should they be dissatisfied with the service provided, in which case the complaint will be reviewed and a refund may be provided at the discretion of the company.
10. Quality and standards of service
10.1: All documents are edited to a high standard. However, we cannot guarantee that edited documents are 'perfect' or free of human error.
10.2: An 'error' refers to an absolute, objective, irrefutable editorial mistake within an edited document (including but not limited to typographical, formatting, punctuation or duplication errors).
10.3: The client is responsible for reviewing the edited document upon completion and contacting the company by e-mail (customerservice@safescribe.co.uk) within 72 hours of receipt of the edited document should any errors be discovered.
All such emails must be sent from the email address used for the order, and must include the order number in the subject field.
10.4: The company will correct any errors as defined in section 10.2 free of charge.
11. Liability
11.1: The company will not be liable for any loss or consequence relating to the client's use of its services or the late delivery of any services. Should the use of the company's services conflict with or breach any regulations or guidelines set by the client's educational institution or another relevant body, the company is in no way liable.
12. Plagiarism
12.1: Plagiarism is deemed unacceptable and condemnable by the company. The company reserves the right to deny services to any individual in cases where evidence exists of plagiarism.
12.2: The company does not take responsibility for any consequences relating to plagiarism already present in documents prior to submission to the company.
13. Force majeure - events beyond the reasonable control of the company
We shall not be liable for any delay or failure to perform any of our contractual obligations if the delay or failure is caused by any circumstances beyond our reasonable control. For the purposes of this condition, "force majeure" shall include, but not be limited to, acts of God, war, terrorism, civil disorder, industrial dispute, fire or explosions. Upon the happening of a "force majeure" event, we shall be entitled to a reasonable extension of time for the performance of our obligations. The client's statutory rights are unaffected.
14. Alterations and amendments to the conditions
These terms and conditions are subject to change at the company's discretion and without prior notice. Any agreement or contract made between the client and the company will be bound by the terms and conditions in effect at the time the client confirms the order on the website unless the change is ordered by law or authority. Any condition which becomes void is deemed removable and does not affect the enforceability or worth of any other conditions.
15. Severability
The paragraphs, subparagraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, subparagraphs or clauses be found invalid, it shall not affect the remaining paragraphs, subparagraphs and clauses
16. Governing Law
This Agreement shall be governed by and construed in accordance with the law of England.
